Foreign companies without a registered office or permanent establishment in Switzerland that become liable for Swiss VAT must appoint a tax representative domiciled in Switzerland – the so-called fiscal representative (Art. 67 Swiss VAT Act). As a rule, a company becomes liable for VAT once it generates a worldwide turnover of CHF 100,000 per year and supplies goods or services in Switzerland.

A fiscal representative is the legally required tax representative of a foreign company in Switzerland (Art. 67 Swiss VAT Act). They serve as the domicile for service of process, act as the point of contact for the Federal Tax Administration (FTA) and ensure that VAT obligations are met correctly. The tax liability itself remains with the represented company.
Foreign companies without a registered office or permanent establishment in Switzerland that are liable for Swiss VAT – for example mail-order and online retailers, assembly and construction companies or providers of digital services. Without a fiscal representative, VAT registration is not possible.
As a rule, a company becomes liable for VAT once its worldwide turnover reaches CHF 100,000 per year and it supplies goods or services in Switzerland. Special rules apply to mail order and online platforms. We will gladly assess your specific situation free of charge.
